Although all efforts to assists veterans in their claims have improved in automation and availability of information, the agency's effort is futile due to the attitude and incompetence of many in the system. Is a problem that we will not be able to addressed unless we call a strike a strike, meaning put the blame where it should be.
First, the system is designed to fault against the claimant, we know it, the department knows it, and all the way to congressmen and their staff know it as well. The veteran's right to assist in their claims as well as been assisted is not respected, making the system a "hostile territory"for the veteran's and their families. I've known of many cases where the veterans has died before he is able to receive a benefit for which he fought for, and this is simple: UNACCEPTABLE!!!!!

Thanks for these tips, Mr. Cooper. I am sharing this blog with my Adult Protective Services Social Worker. She often works with families to get them to assist their elderly parents with financial and personal matters, before they get to the point where the Public Guardian has to step in and petition for conservatorship.

Your tip of playing on parental responsibility is extremely insightful, and may convince otherwise reluctant children to do the right thing. We (APS and Public Guardian) find adult children very reluctant to reverse roles with their elder parent. The parent/child relationship is deeply embedded and difficult to upset. We like when families are able to step in and take ove without defaulting to the government taking over.

Your best advice is to get the parent to prepare an estate plan BEFORE they start to decline. I've gone to court on several cases where competence has been questioned AFTER a person executes a Will or Trust, usually when they've left everything to an unscrupulous family member or acquaintance.

Some states, like California, call it conservatorship, others call it guardianship, but by whatever name it's known, there is a court procedure for obtaining a formal position of responsibility for a disabled adult. If you want to do it yourself, some courts have people to help you and some don't -- you can ask at the court clerk's office. It may be best to speak to one or more attorneys who do this kind of case as part of his or her practice. If you use the services of an attorney, there will no doubt be fees to pay. Consider asking your local county bar association or the clerk's office if there is a legal aid office that can help you for a reduced fee or no fee.

question: I am the mother of a 29 year old Autistic son because of his age I have difficulty speaking with medical providers about his medical conditions is there some way I can obtain guardianship over his medical issues in order to make medical decisions for him and will this cost me an arm and a leg to obtain. Another issue would be providing documentation for such things as his being on jury duty recently I had to have him fill out the form and then get his psychiatrist to fill out the rest. Why is it I cannot just let these systems know about his disability prepare and send out the paperwork without going having to involve him and so many others to provide this information? Thank you in advance for any responses. Joan Williams Adam's mother.
